Repair or Replacement or Cancellation Policy for EVCS
This Repair or Replacement or Cancellation Policy (“Policy”) is provided by Impactware Technology Solutions Private Limited (“goEgo”) to the customers of goEgo (“Customer”) and shall be read along with the Electric Vehicle Charging Station Installation Service Agreement or any other agreement entered between goEgo and the Customer (“Agreement”). By using or agreeing to use the EVCS (as defined below) the Customer agrees to the terms of this Policy. This Policy may be revised from time to time at the sole discretion of goEgo.
2.1. “EVCS” shall mean the electric vehicle charging units/stations manufactured by goEgo and installed at the various sites in accordance with the terms of the Agreement and shall include any replaced or repaired charging unit.
2.2. “Site(s)” shall mean the location where the EVCS has been installed.
3. REPAIR OR REPLACEMENT POLICY:
goEgo agrees that in case of any manufacturing defects or repairs in the EVCS identified within a period of 14 (fourteen) days from the date of installation of EVCS at the Site by the Customer, Customer shall forthwith inform goEgo of such defects or repairs, in writing. Upon the receipt of such written notice, goEgo shall repair or replace the EVCS (which shall be determined by goEgo at
its sole discretion), and its own expense within a reasonable time period. However, the cost of any repair or replacement of EVCS after the expiry of the aforesaid period of 14 (fourteen) days from the date of installation of EVCS at the Site, shall be solely borne by the Customer.
4. CANCELLATION POLICY:
4.1. In the event the Customer wishes to cancel the order of the EVCS, the Customer shall only have the right to cancel the order of the EVCS within 24 hours from the date of Purchase Order or Order Confirmation.
4.2. The Customer shall have the right to cancel the order placed at any time before delivery of EVCS only upon prior written notification to goEgo. goEgo reserves a right to deduct cancellation charges from the total amount refundable to the Customer.
5. REFUND POLICY:
The customer shall pay 50% of the invoiced value to goEgo against the Purchase Order at the time of order confirmation. If the Customer cancels the order of EVCS within 24 hours from the date of the Purchase order, Company shall refund the 50% of the Purchase Order amount to the Customer
In the event of any conflict between the provisions of this Policy and the Agreement or in the event of conflicting provisions in the Agreement, the provisions of this Policy shall prevail to the extent of such conflict and shall be binding on the parties.
